What your trademark status means

These are the statuses on the IP India register, in the order an application usually moves. Open yours to see what it means, the deadline and what we charge to handle it.

  1. New application, formalities chk pass, or marked for examNo action yet

    Your application is filed and waiting in the queue. An examiner will review it and either accept it or issue an examination report.

    Deadline: nothing is due yet. Once an examination report is issued, you have one month to reply.

  2. Formalities chk failAction needed

    The Registry found a problem with the filing itself, usually a missing document, the fee or the applicant details.

    Deadline: fix it as soon as possible. The application won’t move forward until it is corrected.

  3. Objected, or awaiting reply to examination reportAction needed

    The examiner has raised objections, often that the mark is descriptive or similar to an earlier mark. It is not a rejection. It needs a written reply.

    Deadline: reply within one month of receiving the examination report. Extra time can be requested but is not guaranteed, and with no reply the application can be abandoned.

  4. Ready for show cause hearingAction needed

    The examiner was not satisfied with the reply, so a hearing will be held. Hearings appear on the Registry’s public cause list about a month ahead.

    Deadline: attend on the hearing date. If nobody appears, the application can be treated as abandoned.

  5. Accepted and advertised, or advertised before acceptanceWatch

    Your mark is published in the Trade Marks Journal. Anyone can oppose it during the next four months.

    Deadline: the opposition window runs for four months from the Journal date.

  6. OpposedAction needed

    Someone has filed an opposition against your mark after it was published.

    Deadline: file a counter-statement within two months of receiving the notice of opposition, or the application is treated as abandoned.

  7. RegisteredProtected

    Your trademark is registered and protected for 10 years from the filing date. You can now use the ® symbol.

    Deadline: renew before the expiry date to keep it.

  8. Renewal due, or renewal overdueAction needed

    Your registration is reaching the end of its 10 years. Renewing keeps it for another 10.

    Deadline: you can renew up to 12 months before expiry. After expiry there are 6 months to renew with a surcharge, and between 6 and 12 months it can still be restored. After that the mark is lost.

  9. Abandoned, refused or removedTalk to us

    The application or registration has been closed, usually because a reply, hearing or renewal was missed, or because the mark was refused.

    Deadline: some can still be revived. A refusal can be appealed to the High Court within three months, and some abandonments can be challenged, for example when a notice never reached you.
