Why Delhi fashion labels file early
Delhi’s garment trade moves fast: from Gandhi Nagar, which the Delhi government calls Asia’s largest readymade garment market, to the jeans units around Tank Road and hundreds of Instagram and marketplace labels. A label name that sells well gets copied within a season.
Clothing is one of the most crowded classes at the Trade Marks Registry. Names built from common fashion words such as Fashion, Style, Wear, Collection or Trendz are often refused or opposed. A search before you print labels and tags can save you a full rebrand.
Once you file, you can put ™ on woven labels, hang tags and packaging straight away. Marketplaces ask for your trademark application or registration number when you list or enrol your own brand.

Labels, tags, packing and sample runs cost money. If the name is refused after you print, you redo all of it. A search first costs far less.
Common fashion words cannot be owned
Words like Fashion, Denim, Ethnic, Wear or Collection describe the goods. Your protection comes from the distinctive part of the name, or from a logo.
File the logo on your woven label
The logo stitched on your labels and printed on tags can be filed as a device mark, with the name or as a separate application.
Wholesale firm vs your own label
If you trade other brands wholesale and also run your own label, the label name is what to protect. Your firm name needs its own filing only if you use it as a brand.
Marketplace enrolment
Amazon and other marketplaces ask for your trademark number before giving you brand controls. Filing early lets you enrol sooner and report copies.

Questions from Delhi clothing brands
Which class should a clothing brand file in?
Class 25 covers clothing, footwear and headwear. Add class 35 if you sell through your own shop or website under the brand, class 24 if you sell fabrics, and class 18 if you sell bags. We confirm the classes in the free check.
I only sell on Instagram and Amazon. Do I still need a trademark?
Yes. Online labels are copied more easily than shops, and marketplaces ask for a trademark number before giving you brand controls and the right to report copies.
Which Registry office handles Delhi?
Delhi applications are handled by the Trade Marks Registry office in Delhi. We file online, so you never need to visit.

Someone is copying my label name. What can I do?
