Why drug brand names need extra care
Hyderabad is one of India’s biggest pharma hubs, and every new formulation, PCD division and nutraceutical launch needs a brand name. The pharmaceuticals class is one of the most crowded at the Trade Marks Registry, so a new name often sits close to an existing one.
Drug names face a stricter test than most goods. In Cadila Health Care v. Cadila Pharmaceuticals (2001), the Supreme Court said confusion between medicines can harm patients, so even small similarities in sound or spelling matter. Names that sound alike on a phone order, or look alike in handwriting, are a real risk.
Since 2019, the Drugs and Cosmetics Rules also ask manufacturing licence applicants who use a brand name to give an undertaking in Form 51 that, to the best of their knowledge, no same or similar name exists for any drug in India. A proper search, including the Trade Marks Registry, before you finalise the name supports that undertaking.
What to file for a pharma brand
| Class 5 | Medicines, pharmaceutical preparations, nutraceuticals, dietary supplements, veterinary products |
| Class 3 | Cosmetics, skincare and non-medicated toiletries |
| Class 35 | Wholesale, distribution and marketing of pharma products |
| Class 42 | Research, testing and laboratory services |
| Class 44 | Clinics, medical and healthcare services |
Most drug and nutraceutical brands file in class 5. Add class 3 for cosmetic ranges and class 35 if you distribute other brands under your company name. Each class has its own government fee.

Pharma-specific points we check before filing
Sound-alike search, not just spelling
Doctors and chemists often order by phone. We check how your name sounds against existing class 5 marks, not only how it is spelt.
Avoid names built from the molecule
A short form of the generic (INN) name, or an obvious play on it, is weak and often objected to as descriptive. Coined names are easier to register and to defend.
Core brand first, then product names
PCD and third-party businesses run many product names. File the company or division brand first, then the product names that sell the most.
Nutraceuticals and FSSAI
An FSSAI licence does not protect your brand name. Supplements usually go in class 5; food-type products may need class 29, 30 or 32. We confirm the right class.
Keep proof of first use
Invoices, packaging artwork and launch dates help if a conflict comes up later. We record your date of first use in the application.

Questions from Hyderabad pharma companies
Which class should a medicine brand file in?
Class 5 covers medicines, nutraceuticals and dietary supplements. Non-medicated cosmetics go in class 3. If you distribute under the brand, add class 35. We confirm the classes in the free check.
Is the Form 51 undertaking the same as a trademark?
No. The undertaking under the Drugs and Cosmetics Rules is a statement that your brand name is not the same as or similar to an existing drug name. A registered trademark is what gives you the legal right to stop others from copying your name.
Should I search before filing a pharma name?
Yes. Class 5 is crowded and judged strictly, so we recommend Search + File, which includes a Registry search and a clear yes or no opinion before you pay the government fee.
Which Registry office handles Hyderabad?
Telangana and Andhra Pradesh fall under the Trade Marks Registry office in Chennai. We file online, so you never need to visit.
What does it cost in total?
For one class, as an individual or micro/small enterprise: Search + File ₹1,299 + ₹234 GST + ₹4,500 government fee = ₹6,033. Other companies, including medium enterprises, pay a ₹9,000 government fee per class. You get the full total in writing before you pay.
Got an objection on a pharma trademark?
Objections on class 5 names are common. We draft replies from ₹1,999, even if another firm filed your application. Send the examination report on WhatsApp for a free review.
